NOTE: The statements contained herein are only summary in nature. A prospective purchaser should refer to all references, exhibits hereto, the sales contract and the condominium documents.
- All occupants should respect the rights of others. Loud and objectionable noise which may disturb occupants of other units will not be permitted. A period of reasonable quiet shall be observed from 10:00 p.m. to 8:00 a.m.
- No occupant shall use a condominium unit for other than single family purposes.
- No occupant may change the appearance of any exterior surface including the hanging of structures. Lanai shutters must be white in color Mirror type reflected window material is prohibited.
- Food or seed shall not be thrown on Beachway property (including carport) for birds or other animals.
- Children may not play in the elevator, on the stairways or the grass courtyard area including pool deck. Bicycle riding, roller skating, roller blading, skateboarding and Frisbees are prohibited in the courtyard.
- All non-recyclable trash should be put in plastic bags, tied securely and deposited in the trash bin on the first floor or in the chutes next to the storage rooms on the second floor or next to the clubroom on the third floor. All recyclable material should be placed in labeled containers located on each floor in the locked areas next to the stairs by the elevator.
- Each unit has an assigned carport. Second cars and guest cars must be parked in visitors' parking areas. Parking is not permitted along driveways, on grass covered areas or in carports assigned to others. Except for delivery calls or service calls, no trucks, trailers, commercial vehicles, motorcycles or motor bikes may be kept or operated on Beachway property. Campers or motor homes shall not be kept or occupied on Beachway property.
- Guests of owners and renters must display Beachway guest parking permits if vehicles are left in the guest parking area. Permits will be furnished by the Beachway Condominium Association. Failure to observe this rule may result in tow-away at the owner's expense.
- Occupants shall not hang laundry, garments, rugs, towels or other unsightly objects on walkway railings or other areas that are visible outside the condo unit. Personal items, furniture, etc. should not be left in the mentioned areas or common areas.
- Shuffieboard equipment should be returned to the men's room after use. Children under twelve should be accompanied by an adult.
- Outside grilling shall be limited to the designated grills near the pool shower. Gas grills must be turned off and cleaned after use.
- Common elements such as laundry rooms, clubroom, rest rooms, storage rooms and recycling rooms are to be locked when not in use. Owners' keys will open all of these areas.
- Appliances in the club room are to be used only for condo social functions. An exception will be made for an emergency such as an individual's appliance breakdown. When not in use, the club room refrigerator should be set at "A" and "I". If anyone wishes to reserve the club room for special functions, requests should be made in writing to a Board Member. The club room is not a playroom. Children should be accompanied by an adult when in the room.
- No pets are allowed at Beachway as of February 18, 1994, when the Declaration of Condominium was amended and adopted at the meeting of the members of the Beachway Condominium Association. Section 13.(u) now reads: "No owner, tenant or other occupant of a condominium unit shall be permitted to have any pet. However, present owners as of the date of this amendment shall be permitted to keep the pets they currently own. All pets shall be kept on a leash when not in the unit. No pets shall be permitted in the common areas. Any applicant for lease or purchase who has a pet shall be disapproved by the Association."
- For protection of the units, locks on doors must not be changed unless keyed to the master key.
- In absence of unit owner, no more than five persons may stay overnight in a unit. In the event the unit is renter-occupied, the owner or owner's rental agent should confront tenants if the occupancy is over the limited number.
- Use of Beachway common property i.e. (Clubroom) including but not limited to business or commercial entertaining is prohibited. Any gatherings that include other than Beachway owners, tenants or guests must be approved in writing by the Beachway Board of Directors.
- No person is permitted in the common areas when under the influence of alcohol or illegal drugs.
- No smoking in the club room or elevator.
- No one is permitted on the roof except Board Members and authorized workmen.
- Anyone having an air conditioning compressor replaced on the roof must arrange to have this done with the use of a crane or cherry picker.
- Any damage to building, recreational facilities or other common areas caused by owners, guests, renters or visitors, shall be repaired at the expense of the owner.
- Visitors must be accompanied by a resident when using the common elements.
- Non-resident owners are considered as visitors if their units are occupied by renters or lessees.
- A copy ofthe Beachway Rules and Regulations along with a separate pool regulations list will be placed in each unit.
- Lessees may not take possession of a unit until the lease application has been approved by the Board of Directors. According to the Amended Declaration of Condominium (February 18, 1994) "The Board of Directors shall have the authority to levy reasonable fines against a unit owner for failure ofthe unit owner, its occupant, lessee, invitee, or tenant to comply with any provision of the Declaration, by laws, or reasonable rules of the Association. The procedure for assessing fines shall be in accordance with the Florida Condominium Act and Florida Administrative Code in effect at the time the fine is levied."
- Bikes parked in bike rack should be locked and have attached an identification tag as to ownership.

- Always use towels on pool furniture.
- If you move pool furniture, please re-position it.
- ALWAYS LOCK POOL GATES. THIS IS MANDATORY FOR PROPER INSURANCE COVERAGE. OWNERS MUST INFORM GUESTS AND RENTERS OF THIS REGULATION.
- No glass or breakable materials permitted on pool deck.
- No Styrofoam floats. (Particles clog circulation)
- Inflatable mattresses may be used. However, if the pool is crowded, please desist. We trust your judgment on this.
- Please see to it that children and incontinent adults wear waterproof or ecology garments.
- No organized games in the pool area, with the exception of shuffleboard. BALLS, FRISBEES OR OTHER TOSSES OBJECTS ARE PROHIBITED.
- Children under 12 must be accompanied by an adult when using shuffleboard equipment, which must be returned to the men's room.
- Running, horseplay and excessive noise are prohibited.
- Please use foot showers before entering pool, also when coming from the beach.
- After using grills, please clean grids and be very certain gas is turned off. PLEASE DOUBLE CHECK!!
- Children under 12 must be accompanied by an adult in the pool area.
- No diving is permitted.
- Swim at your own risk. There is no lifeguard on duty, ever.
- Nearest phone is across the street, at the beach.
- County regulations: pool capacity 19 persons.
